Yong Vui Kong, a 23-year-old Malaysian man, has lost his final judicial appeal against a mandatory death sentence. On 4 April 2011, the Singapore Court of Appeal, Singapore's highest court, dismissed Yong Vui Kong's appeal. He was sentenced to death in January 2009 for trafficking 47 grams of heroin, a crime committed when he was 19 years old. Yong Vui Kong is now at imminent risk of execution unless Singapore President SR Nathan grants clemency, a request that the President had previously rejected. Now they're petitioning to the new President Tony Tan for clemency to commute Vui Kong to life imprisonment. Yong Vui Kong, a Malaysian from the state of Sabah, was sentenced to death on 4th December 2009 for trafficking drugs in Singapore. He was arrested in June 2007 and charged with trafficking 42.27 grams of heroin, when he was 19 years of age. On 9 April 2011 Cheong Chun Yin's family and the Save Vui Kong Campaign urged the Singapore government to reopen Chun Yin's case, due to a possible miscarriage of justice. Chun Yin had been convicted of trafficking 2.7kg of heroin in February 2010, and sentenced to death under the Mandatory Death Penalty. The Court of Appeal upheld the decision in October 2010. Till this day, he maintains that he did not know that the suitcase he had carried contained heroin. He had believed that the suitcase had contained gold bars. During his investigation, Chun Yin had revealed the name, physical description and phone numbers of his contact, "Lau De" to the authorities. However, the CNB officers did not attempt to investigate or trace "Lau De". In his written judgement High Court Judge Choo Han Teck stated that "[i]t was immaterial that the CNB did not make adequate efforts to trace 'Lau De' or check on his cell-phones." The court has ruled that sentence contravenes the rights of convicted person terming it a degrading punishment. The three appellate judges Riaga Omollo, Erastus Githinji and Philip Waki said the sentence meted out to convicts needed to be in line with the nature of the crime committed. The appellate judges however maintained in their ruling that in appropriate cases the courts will continue to impose the death penalty. The lawyers who contested the rationale behind the blanket death sentence Advocates William Wameyo and Timothy Bryant said this ruling will now open doors for the revision of sentences especially those where the charges ranged from robbery with violence to murder. This incident took place in Jul 2010 in Singapore. 75-year-old British citizen Alan Shadrake was released on bail after being interrogated by the Singapore Police for more than 24 hours.
