As our regular followers know David has been following this story closely as it has proceeded starting Sept 12th of this year. As David points out in the video the Arizona Supreme Court has posted two PDF's on its website for the Closing Arguments and the Findings of Fact and Conclusions of Law. A 24 hour notice will be given to all parties, media and the public about the hearing. dmcantor.com Today David Michael Cantor, a Phoenix DUI Attorney, talks about Andrew Thomas' recent decision to drop his lawsuit against Maricopa County and the state of Arizona. Thomas was suing the county and state for professional and personal damages he claims stemmed from conflicts with county officials, and other judicial officials in the state. He was even going after the Arizona State Bar. David finds the timing of all of this to be a bit suspect and speculates that Thomas knew he didn't have a case and needed to get out of this ordeal. The irony of course is that the 'conflicts' he cites in his case were due to his actions as county attorney. Throughout Thomas' tenure in office he went after a multitude of political opponents with the power of his office. This has lead to Thomas' investigation by the Arizona State Bar and a federal grand-jury investigation into abuse of power. His Bar hearing is set to begin on Sept 12th and we anxiously await to see how this turns out. Today David talks about Thomas' response to the "legitimacy of the State Bar of Arizona's case to have him disbarred". Thomas is arguing that "the state Bar's independent investigator, John Gleason" is not qualified to handle the case since he is not licensed to practice law in Arizona. He also argues that the Supreme Court's probable-cause panelist, former Chief Justice Charles Jones, went beyond his authority by recommending that Thomas be disbarred. If you have watched our Blog before you may have seen our video on Pro Hoc Vice. In that video David explains how Lawyers can practice law in any state whether they are licensed for that particular state or not. This is how OJ's dream team was brought together. So it seems that Mr. Thomas is confused about how that part of the law works. His statement about Chief Justice Charles Jones going too far in his recommendation of disbarment for the former Maricopa County Attorney. So the body responsible for ruling on a lawyers disbarment cannot make the recommendation? That is another odd interpretation of Law Mr. Thomas.
